Introduction

At Modest Pattern Photography, we strive to provide exceptional photography services that meet or exceed your expectations. We understand that circumstances may arise that require cancellation or changes to your booking. This Refund Policy outlines the conditions under which refunds are processed for our services.

By booking our services, you agree to the terms of this Refund Policy. Please read it carefully to understand your rights and obligations regarding refunds and cancellations.

Deposits and Payments

Our payment structure is as follows:

  • A non-refundable deposit of 25% of the total service fee is required to secure your booking date and time.
  • The remaining balance is due no later than 7 days before the scheduled session date.
  • For bookings made less than 7 days in advance, the full payment is required at the time of booking.

The deposit serves to reserve our services for your specified date and time, during which we may decline other booking opportunities. For this reason, deposits are generally non-refundable, with specific exceptions outlined below.

Cancellation Policy

If you need to cancel your photography session, the following refund terms apply:

Portrait, Family, and Commercial Sessions

  • Cancellation more than 30 days before the session: Full refund of any payments made, excluding the non-refundable deposit.
  • Cancellation 14-30 days before the session: 50% refund of any payments made beyond the deposit.
  • Cancellation less than 14 days before the session: No refund will be provided.

Wedding and Event Photography

  • Cancellation more than 90 days before the event: Full refund of any payments made, excluding the non-refundable deposit.
  • Cancellation 30-90 days before the event: 50% refund of any payments made beyond the deposit.
  • Cancellation less than 30 days before the event: No refund will be provided.

All cancellation requests must be submitted in writing via email to [email protected]. The date of the email receipt will be used to determine the applicable refund amount.

Rescheduling Policy

We understand that circumstances may require you to reschedule your photography session. Our rescheduling policy is as follows:

  • Rescheduling more than 14 days before the session: One free reschedule to a new date within 6 months of the original date, subject to our availability.
  • Rescheduling 7-14 days before the session: Rescheduling fee of 15% of the total session fee, with the new date to be within 6 months of the original date.
  • Rescheduling less than 7 days before the session: Rescheduling fee of 25% of the total session fee, with the new date to be within 6 months of the original date.

All rescheduling requests are subject to our availability. If we cannot accommodate your preferred new date, we will work with you to find an alternative date. If no suitable date can be found, our standard cancellation policy will apply.

Weather-Related Rescheduling

For outdoor sessions affected by adverse weather conditions:

  • If we determine that weather conditions will significantly impact the quality of your photographs, we may suggest rescheduling at no additional fee.
  • If you choose to proceed with the session despite our recommendation to reschedule due to weather, no refunds will be provided based on dissatisfaction with weather-affected results.
  • Weather-related rescheduling decisions will typically be made 24-48 hours before the session and communicated to you promptly.

Service Dissatisfaction

We are committed to providing high-quality photography services and client satisfaction is our priority. In the rare event that you are dissatisfied with our services:

  • You must notify us in writing within 14 days of receiving your images, detailing the specific reasons for your dissatisfaction.
  • We will review your concerns and may offer one of the following solutions at our discretion:
    • Additional editing of the images to address specific concerns
    • A complimentary mini-session to capture additional images
    • A partial refund based on the nature and extent of the issue
  • Full refunds for service dissatisfaction are rare and evaluated on a case-by-case basis.
  • Stylistic preferences (such as editing style, posing choices, or creative direction) that were consistent with our portfolio are not grounds for refunds.

Please note that photography is both a technical and artistic service. While we strive for technical excellence, the artistic interpretation and style are inherent to our brand. We encourage you to review our portfolio thoroughly before booking to ensure our style aligns with your preferences.

Special Circumstances and Exceptions

Illness or Emergency

In cases of serious illness or genuine emergency:

  • If you need to cancel due to serious illness, family emergency, or bereavement (with documentation), we may waive cancellation fees and offer rescheduling without penalties or provide a credit toward future services.
  • If we need to cancel due to illness, emergency, or unforeseen circumstances, we will make every effort to find a qualified replacement photographer. If no replacement can be secured, we will offer you the option to reschedule at no additional cost or receive a full refund including the deposit.

Force Majeure

Neither party shall be liable for failure to perform due to events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Acts of terrorism or war
  • Public health emergencies
  • Severe weather conditions making photography impossible or unsafe

In such cases, we will work with you to reschedule the session at no additional cost or provide a credit for future services if rescheduling is not possible.

Refund Processing

When a refund is approved, the following process applies:

  • Refunds will be processed using the same payment method used for the original purchase when possible.
  • Refunds typically process within 7-10 business days, though timing may vary depending on your payment provider or banking institution.
  • You will receive an email confirmation when your refund has been processed.
  • For payments made by credit or debit card, please note that it may take an additional 2-10 business days for the refund to appear on your statement.

Product Orders and Physical Items

For physical products such as prints, albums, and other photography merchandise:

  • Custom-designed products (albums, wall art with custom edits, etc.) are non-refundable once production has begun.
  • If you receive damaged products, you must notify us within 7 days of receipt with photographs of the damage. Replacement items will be provided at no additional cost.
  • Returns of non-custom products in original condition may be accepted within 14 days of receipt, subject to a 15% restocking fee.
  • Shipping costs for returns or exchanges are the responsibility of the client unless the product was damaged or incorrect due to our error.

Policy Updates

We reserve the right to modify this Refund Policy at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following any changes constitutes your acceptance of the modified Refund Policy.
